FDA issues first warning letters to unauthorized synthetic vape manufacturers

As of Thursday, no new vapes containing synthetic nicotine are legally allowed to be sold.

The Food and Drug Administration late Wednesday issued two warning letters to companies selling electronic cigarettes that contain lab-made nicotine for failing to provide the necessary applications to the agency to continue selling their products.

AZ Swagg Sauce LLC and Electric Smoke Vapor House, the companies that received the warning letters, offer some 10,000 products between them.

Additionally, the agency announced that it had issued 107 warning letters to other companies selling synthetic vapes to minors. However, the warning letters do not address the ongoing sale of other synthetic vape products, covering nearly 1 million devices from about 200 companies, that have already submitted marketing applications to the FDA.

“The warning letters announced today are just the beginning of our compliance and enforcement actions,” Brian King, the new director of the FDA’s Center for Tobacco Products, said in a statement. “In the coming weeks, we will continue to investigate companies that may be marketing, selling or distributing non-tobacco nicotine products illegally and will pursue action, as appropriate.”
